These Terms of Use (“Terms”) govern your access to and use of datarob.com and its pages (the “Site”), operated by Datarob OÜ, Sakala tn 7-2, 10141 Tallinn, Estonia (“Datarob”, “we”, “us” or “our”). Datarob and Hiretop are brands of Datarob OÜ.
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you use the Site on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms on its behalf. If you do not agree, please do not use the Site.
1. About the Site and our services
The Site provides general information about Datarob and our data engineering services, including embedding data engineers into client teams. Information on the Site is provided for general information purposes only and does not constitute an offer, proposal or professional advice.
Any services we provide are governed exclusively by a separate written agreement between you and Datarob OÜ (for example, a services agreement and statement of work). In case of any conflict between these Terms and such an agreement, the agreement prevails.
2. Engineer profiles, rates and availability
Engineer profiles and CVs published on the Site are anonymized and provided solely to help you evaluate whether our engineers fit your needs. Skills, experience, rates and availability are indicative, may change at any time and become binding only when confirmed in a written agreement. Stated timelines, such as how quickly an engineer can start, depend on your requirements and processes and are not a guarantee.
You agree not to use profiles or any information obtained through the Site or through our introductions to identify, contact, engage or hire an engineer directly or through a third party in order to bypass Datarob. Any engagement of an engineer introduced by us is subject to our commercial terms.
3. Acceptable use
When using the Site, you agree not to:
- use the Site in any way that breaches applicable laws or regulations;
- attempt to gain unauthorised access to the Site, its servers or any connected systems, or interfere with their operation or security;
- introduce viruses, malware or any other harmful or malicious code;
- use robots, scrapers or other automated means to collect content or data from the Site without our prior written permission;
- submit false, misleading or unlawful information, or impersonate any person or organisation;
- send unsolicited advertising or spam through our forms or contact details.
4. Information you send us
When you submit a form, email us or share documents, you confirm that the information is accurate and that you have the right to share it with us, including any personal data of third parties. We treat business information you share with us as confidential and use it only to respond to you and to prepare or deliver our services. We are happy to sign a non-disclosure agreement before you share sensitive information.
5. Intellectual property
The Site and all of its content — including text, graphics, illustrations, logos, the Datarob and Hiretop names and trademarks, page layout and code — are owned by or licensed to Datarob OÜ and are protected by intellectual property laws. You may view the Site and print or download pages for your own internal, non-commercial use. You may not copy, reproduce, modify, distribute, republish or otherwise use any content without our prior written consent, except as permitted by law.
6. Third-party links and content
The Site may contain links to, or embedded content from, third-party websites and services, such as LinkedIn and Clutch. We do not control and are not responsible for their content, availability or practices. Accessing them is at your own risk and subject to their terms and policies.
7. Availability of the Site
We aim to keep the Site available and up to date, but we do not guarantee that it will be uninterrupted, timely, secure or free of errors. We may change, suspend or withdraw all or any part of the Site at any time without notice.
8. Disclaimer of warranties
The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. Case studies and examples describe past results and do not guarantee similar outcomes.
9. Limitation of liability
To the fullest extent permitted by law, Datarob OÜ shall not be liable for any indirect, incidental, special or consequential loss or damage, or for any loss of profit, revenue, data or business opportunity, arising out of or in connection with your use of, or inability to use, the Site or reliance on its content. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence.
10. Indemnity
You agree to indemnify Datarob OÜ against claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Site, to the extent permitted by law.
11. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Republic of Estonia. The courts of Estonia, with Harju County Court (Harju Maakohus) as the court of first instance, have jurisdiction, unless mandatory law provides otherwise. We encourage you to contact us first so that we can try to resolve any concern amicably.
12. Changes to these Terms
We may update these Terms from time to time. The updated version will be published on this page with a new “Last updated” date and applies from the moment of publication. Your continued use of the Site after changes are published means you accept the updated Terms.
13. General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding your use of the Site.
